Texas PUC Executive Director Dings REPs For Non-Response To "So-Called Voluntary RFIs" Concerning Industry Response To Hurricane Beryl

During today's open meeting, Texas PUC Executive Director Connie Corona said that the PUC has received only four responses from retail electric providers in response to what Corona termed "so-called voluntary RFIs" issued by PUC Staff to REPs as part of Staff's investigation of utility and industry responses to Hurricane Beryl and the May 2024 derecho
"That's not quite at the level that I would like to see," to assist Staff in providing a broad overview as part of a report on Staff's investigation of utility and industry responses to the disasters, Corona said
Based on filings as of publication time, it appears Corona was counting REP affiliates as a single REP if such REPs filed a joint response. Responses by individual REPs, or individual REP families, have been filed by: ENGIE Resources LLC; Champion Energy Services, LLC & Calpine Energy Solutions, LLC; NRG Energy on behalf of its REPs; and Vistra on behalf of its REPs
However, a group of various unaffiliated REPs also filed a joint response to the RFIs, as the Aggregated REP Group (consisting of APG&E;
174 Power Global Retail Texas, LLC dba Chariot Energy;
Constellation NewEnergy, Inc.;
Demand Control 2, LLC;
Direct Energy LP;
Frontier Utilities, LLC;
Fulcrum Retail Energy, LLC;
Gexa Energy, LP;
Green Mountain Energy Company;
Just Energy Texas, LP;
Reliant Energy Retail Services LLC;
Rhythm Ops, LLC;
Shell Energy Solutions;
Stream SPE, Ltd.;
Tara Energy LLC;
U.S. Retailers LLC (Cirro Energy and Discount Power); and
XOOM Energy Texas, LLC)
Additionally, the Alliance for Retail Markets and Texas Energy Association for Marketers also each filed separate responses to the RFIs
As previously reported by EnergyChoiceMatters.com, the RFIs asked, among other things, questions concerning REP communications with customers about the disasters, and the percentage of a REP's customers that had 'opted-in' to providing their contact information to the customer’s TDU (see full questions here)
When the RFIs were issued, they included a statement from the PUC's Deputy Executive Director informing REPs that, "While encouraged, your participation in this investigation is purely voluntary[.]"
PUC Chair Thomas Gleeson hoped that the PUC would get outstanding responses to the RFIs as soon as possible
In responses to the RFIs, and specifically in responses to questions seeking input on key lessons learned or other concerns revealed by REPs' experience during the disasters, several REP parties have said that the PUC should explore having TDUs bear the financial responsibility arising from extended, unilateral disconnect for non-pay moratoriums (see story here)
