Update On Enron Energy Texas REP Application (5/9)

While EnergyChoiceMatters.com typically does not cover routine or administrative developments in retail supplier licensing proceedings, because of intense reader interest in the Texas REP application of Enron Energy Texas LLC ("Enron"), ECM provides the following update for those counting the days since the initial application.
On May 9, Texas PUC Staff recommended that Enron's application for an Option 1 REP certificate, as supplemented, be deemed sufficient for further review.
Staff's recommendation does not address the merits of the application. Rather, Staff's recommendation addresses whether all materials necessary for the PUC to conduct an application review have been filed, in order for the PUC to review the application.
An ALJ must still rule on whether Enron's application is sufficient for further review. A finding that the application is sufficient for further review would then start a clock for an ultimate decision by the PUC on the application.
Specifically, except where good cause is shown to extend consideration, the Texas REP certification rules require the PUC to issue an order approving, rejecting, or approving with modifications a REP application within 90 days of a finding that the application is sufficient for further review.
