ERCOT Reports "Widespread Noncompliance" With Reporting Obligation Applicable To All Market Participants

ERCOT on May 30 issued a market notice concerning "widespread noncompliance" with the reporting and attestation obligations regarding the purchase of critical electric grid equipment (CEGE) and critical electric grid services (CEGS)

ERCOT said that all Market Participants are required to submit ERCOT Protocols Section 23, Form S (LSIPA Attestation) to ERCOT, regardless of whether the Market Participant actually purchased any CEGE or CEGS during the applicable reporting periods.

If a Market Participant did not purchase CEGE or CEGS during the reporting periods, the Market Participant must submit an LSIPA Attestation that answers Question 1 as "Not True."

Over 500 Market Participants have failed to submit an LSIPA Attestation as required by ERCOT Protocols Sections 16.1.4(2)(a)-(b), ERCOT said

All Market Participants that failed to submit either or both required LSIPA Attestations must submit the required LSIPA Attestation(s) to ERCOT no later than June 30, 2025.

In addition to filing a list of non-compliant Market Participants with the Texas PUC, ERCOT said in the notice that, "ERCOT reserves the right to take further action regarding Market Participants that fail to submit their LSIPA Attestations."

ERCOT said that submission of an LSIPA Attestation is a condition for the continuing operation of the Market Participant in the ERCOT Region.

There were two deadlines by which all Market Participants were required to submit an LSIPA Attestation.

First deadline: ERCOT Protocols Section 16.1.4(2)(a) required each Market Participant to submit an LSIPA Attestation for CEGE or CEGS purchases made after June 18, 2021, to ERCOT by October 28, 2024.

Second deadline: ERCOT Protocols Section 16.1.4(2)(b) required each Market Participant to submit an LSIPA Attestation for CEGE or CEGS purchases made between June 8, 2018 through June 18, 2021, to ERCOT by December 15, 2024.

Market Participants that failed to submit LSIPA Attestations must submit their past due LSIPA Attestation(s) to ERCOT by June 30, 2025. All Market Participants are required to submit an LSIPA Attestation to ERCOT, regardless of whether the Market Participant purchased any CEGE or CEGS during the applicable reporting periods.
