Enron Files Additional Material In Support Of Texas Retail Provider Application

Enron Energy Texas LLC (Enron) has filed additional materials in support of its application for an Option 1 Texas retail electric provider (REP) certificate, following a recommendation from Staff of the Texas PUC that Enron's application should be denied from a technical and managerial perspective.

In addition to filing supplemental materials, Enron stated in its filing that it is continuing to communicate with Staff to get clarification on the exact issues that Staff identified in Staff's recommendation. Enron's supplemental filing was made in advance of receiving the sought clarity from Staff, and Enron requested, and was granted, an extension in order to allow time for Enron to receive further clarity from Staff and to provide further information or response as may be sought.
Specifically, Enron said in its filing: "In response to Staff’s recommendation on final disposition, Enron Energy reached out to
Staff to confer and get clarification on the exact issues that Staff identified in its recommendation.
As part of those communications, Enron Energy submitted two questions to Staff about its
recommendation on June 19, 2025. Staff initially indicated that it would try to provide answers to
Enron Energy by June 27, 2025, but recently informed Enron Energy that the questions are still
being reviewed. In the interim, and in recognition of the upcoming July 7 deadline, on June 26,
2025, Enron Energy reached out to Staff to confer and sent Staff an advance copy of Enron
Energy’s updated supplemental information for attachments D-2 and D-3, with resumes and
addenda, to its Application. On June 27, 2025, Staff confirmed that it is currently reviewing Enron
Energy’s supplemental information, but would need the information filed in the docket before Staff
could revise its final recommendation."
Enron further said in its filing: "In anticipation of Staff’s review and as a result of the communications referenced above,
Enron Energy respectfully files its updated supplemental information for attachments D-2 and D-
3, with resumes and addenda, to its Application, included in Exhibit A hereto."
Enron further said in its filing: "Under 16 TAC § 22.4(b), a request may be submitted for good cause to extend the time
allowed for filing any documents. As set forth above, Staff is currently reviewing the two questions
that Enron Energy submitted to Staff on June 19, 2025, as well as Enron Energy’s supplemental
information submitted to Staff on June 26, 2025. Enron Energy is awaiting the results of Staff’s
review, and any revisions to Staff’s recommendation on final disposition, in order to complete its
response to Staff’s recommendation. Accordingly, to give Enron Energy time to review Staff’s
forthcoming information or recommendation, Enron Energy respectfully requests an extension of
its July 7, 2025, deadline for one week, until July 14, 2025."

In terms of the supplemental material filed thus far, Enron filed further specifics on prior position titles and employers, and employment periods for such, for Gregory A. Forero, clarifying that such positions were specifically related to competitive power and/or gas markets as applicable (for example, the supplemental material in the standard D-2 attachment reports Forero as previously serving as Vice President, Power at Constellation, whereas the original filing in D-2 had listed this Constellation position as less specifically "Vice President", though the originally attached resume had also included specific details describing such position, including, among other things, a description of the position as including the origination and management of, "power offerings to REPs".
Additionally, the supplemental materials include a resume addendum for Forero that includes additional narratives concerning how the positions involved experience in the competitive electric and gas markets.

Additionally, Enron's supplemental filing includes, for Evan Caron, a resume and list of prior positions to meet the competitive electric or gas industry experience relied upon to meet technical qualifications. Caron had previously been identified in prior submissions by Enron as a Vice President at Enron, but Enron had not, at least in the non-confidential portions of Enron's filings, previously provided a resume or prior positions held by Caron.
The additional materials confirm that Caron held various positions in electric and natural gas marketing for two decades, including, among other positions, Managing Director/President: Head of NA Electricity Commodities-Trading at Trailstone Group; and Managing Director: Commodities/ERCOT Trading at Mercuria Energy Trading. Caron previously served as a Board Member at MP2 Energy and is a co-founder of HGP Storage
