Texas QSE To Pay $40,000 Under Settlement With PUC Staff

GridBeyond, LLC would pay $40,000 under a settlement with Staff of the Texas PUC to resolve alleged violations of 16 Texas Administrative Code (TAC) §§ 25.503(g)(3) and
25.507(d)(6), and Electric Reliability Council of Texas (ERCOT) Nodal Protocols §§ 8.1.3.1.4 and
8.1.3.2, related to event performance criteria for emergency response service (ERS) resources and
testing of ERS resources.
The settlement states that, as a QSE, GridBeyond was contracted to provide non-weather sensitive ERS-30 over multiple time
periods during the October — November 2021, December 2021 — March 2022, April — May
2022, June — September 2022, October — November 2022, December 2022 — March 2023,
April - May 2023, and June — September 2023 Standard Contract Terms.
The settlement states, "From October 2021 through March 2023, ERCOT conducted 18 deployment tests on
GridBeyond ERS resources resulting in 12 failed deployment tests."
An agreed proposed order in the case states, "Of the GridBeyond resources tested by ERCOT during this period, two GridBeyond ERS
resources failed at least four consecutive ERCOT deployment tests."
The settlement states, "From October 2021 through March 2023, GridBeyond violated 16 TAC § 25.503(g)(3) on
two occasions by offering ERS resources for reliability services that had failed four
previous deployment tests. As a result, the offered resources appeared to be incapable of
providing the contractually obligated ERS services if deployed during an actual event."
The settlement also lists two deployments, one in 2022 and one in 2023, in which GridBeyond failed to
meet its obligation during the first full interval and had an eventpf of 0.391 and 0.342, respectively
The settlement notes that, "GridBeyond self-reported to the ERCOT Reliability Monitor after learning that the
GridBeyond operator failed to follow dispatch procedures during the July 13, 2022, ERS
deployment. This self-report was submitted prior to determining the ERS portfolio event
performance."
The settlement notes that, "GridBeyond has improved performance of its portfolio by updating processes supported
by investments in monitoring, alarming and dispatch tools at its Network Operation Center
(NOC), encouraging the adoption of customer control technology to ensure the reliability
and availability of the committed ERS resources, eliminating under-performers, and
modifying offer volumes and time periods."
The settlement notes that, "GridBeyond has removed
customers from its ERS portfolio who have been unwilling or unable to consistently
perform or have been reluctant to allow third party optimization. GridBeyond has
terminated a NOC operator that failed to follow required processes that was the root cause
of the underperformance of the ERS deployments on July 13, 2022."
The settlement states that, "GridBeyond also has invested in its business,
its team, and at its customers’ facilities to deliver services to ERCOT in a reliable and
consistent way by automating to the fullest extent possible ... These investments
have improved GridBeyond’s customers’ performance."
