Texas ALJ Extends Time For Consideration Of Enron Energy Texas LLC's REP Application

A Texas ALJ has extended the time for review of Enron Energy Texas LLC's application for an Option 1 retail electric provider certificate.
Under 16 Texas Administrative Code (TAC) § 25.107(c)(3), a presiding officer will issue an order approving, rejecting, or approving with modifications, a REP application within 90 days of a finding that the REP's application is sufficient for review, except where good cause exists to extend the time for review.
The ALJ confirmed that, based on when Enron Energy Texas, LLC's application was deemed sufficient for review, the 90-day deadline falls on Monday, August 11, 2025.
"In light of the recent filings, the multiple extensions requested by the parties over the course of this case, and the lack of agreement on final disposition between the parties, the ALJ finds good cause exists under 16 TAC § 25.107(c)(3) to extend the time for review in this proceeding," the ALJ said
The ALJ ruled that additional deadlines for continued processing of the application proceeding will be established in a future order.
As previously reported, PUC Staff have recommended that Enron Energy Texas LLC's application be denied and dismissed with prejudice, while Enron Energy Texas LLC has argued that Staff's recommendation is not supported by rule and would be discriminatory, arbitrary and capricious.
