Texas Aggregator Applicant Seeks Waiver Of PUC Rule Requiring Aggregators To Have Fax Number

Simplified Power Houston LLC has applied for a Texas electric aggregator certificate, and, in doing so, requested, pursuant to 16 Texas Administrative Code § 22.5 (b), a good cause wavier of the current requirement, under the aggregator rules at 16 Texas Administrative Code § 25.111(f)(1), for an aggregator to provide a fax number for a Texas regulatory contact person and for an agent for service of process
For all aggregator types, the PUC aggregator rules require that the applicant provide, "Name, physical business address, telephone number, fax number, and e-mail address for a
Texas regulatory contact person and for an agent for service of process, if a different
person."
The PUC's aggregator rules had an effective date of June 28, 2000, and do not appear to have been updated since such adoption in June 2000
Simplified Power Houston LLC stated in its request that, "We have no fax number which is one of the required pieces of information in the registration process."
Simplified Power Houston LLC stated, "We no longer use fax communications as all our clients find this as an outdated form of communication. We maintained a fax number for nearly three years but had zero requests or applications and discontinued our account with fax.com."
Simplified Power Houston LLC, which was organized earlier this year, is currently registered as a Texas electric broker
As an aggregator, Simplified Power Houston LLC requested registration to serve commercial customers, and stated that the company also wishes to aggregate churches
Daniel McCarthy serves as President of Simplified Power Houston LLC. Daniel McCarthy also serves as President of the distinct entity Simplified Power Inc. The entity Simplified Power Inc. currently holds a Texas broker registration and has operated in Texas for decades
