Broker Discloses Investigation By State Utilities Commission

In a customary Ohio electric broker/aggregator license renewal application, Arbor Energy Brokerage Services LLC (AEBS) reported that, "AEBS is actively resolving a non-public investigation with a state utilities commission," and that AEBS expects that a settlement will be finalized within 60 days

AEBS filed with PUCO further specifics concerning the investigation on a confidential basis, and requested that PUCO grant such confidential treatment

AEBS said that PUCO Staff, notwithstanding the sought confidential treatment, is able to review the specific information filed by AEBS concerning the investigation

As noted below, AEBS is seeking confidential treatment for a limited time period until confidential settlement discussions with the non-Ohio utilities commission conclude.

Public disclosure of the investigation specifics at such time will be of interest to the market as, on a relative basis, few actions are brought by PUCs and similar agencies against brokers, in comparison to retail suppliers. Aside from technical compliance issues (such as non-renewal of a bond), most actions to date involving "brokers" have been against entities better characterized as marketing vendors (who may hold a broker license). Connecticut, due to its unique definition and precedent concerning what Connecticut terms an aggregator and its consideration of agency relationships, has seen greater regulatory activity concerning channel partners.

AEBS in a filing with PUCO said, "Due to ongoing confidential settlement discussions with a state commission to resolve this matter, AEBS seeks to keep Exhibit B-3 out of the public domain until the matter is resolved. AEBS expects that the settlement will be finalized with the state commission within sixty (60) days, after which AEBS will file a public version of Exhibit B-3."

AEBS in a filing with PUCO said, "AEBS’s motion is reasonable to protect competitively sensitive information during ongoing confidential settlement discussions. The state commission investigation at issue is not currently public and is not known outside AEBS and the state commission staff working on the matter. Requiring AEBS to publicly disclose information relating to ongoing settlement discussions regarding a matter that is not otherwise public could provide sensitive information to AEBS’s competitors prior to a possible resolution or enable AEBS’s competitors to attempt to interfere with or misrepresent this process in the marketplace."

AEBS in a filing with PUCO said, "AEBS only seeks to protect the disclosure for a short period of time until the settlement discussions have resolved."

AEBS in a filing with PUCO further said, "beyond this one matter, there are no other liabilities of investigations to AEBS to disclose."

Arbor Energy Brokerage Services provided the following statement to EnergyChoiceMatters.com concerning the matter:
