Texas REPs Ask Whether TDU Would Commit To New REP Affiliate (If Merger Approved) Not Becoming Option 1 REP

The Texas Energy Association for Marketers (TEAM), in an RFI in the Texas PUC proceeding reviewing a proposed merger under which Texas-New Mexico Power Company would become an indirect subsidiary of Troy ParentCo LLC (Troy) and Blackstone Infrastructure, asked whether TNMP, as part of the commitments in the proceeding, would commit that "it" will not convert "Lancium QSE, LLC" [sic] to an Option 1 retail electric provider

As previously reported, as a result of the merger, Option 2 retail electric provider Lancium QSE I LLC would become a competitive affiliate of TNMP, due to Blackstone's investment and stake in Lancium LLC.

Option 2 REPs are limited to serving customers 1 MW and larger which provide an affidavit agreeing to such service

Among other RFIs, TEAM also issued an RFI as follows: "Please refer to the Direct Testimony of Heidi Boyd, Exhibit HB-4, Regulatory Commitment No. 26, which asserts that 'to the extent that any retail electric provider is affiliated with TNMP, TNMP will not seek to recover from its customers any costs incurred as a result of a bankruptcy of any such affiliate.' Admit or deny: under this commitment, TNMP would be able to recover costs incurred as a result of an affiliate’s debts in a manner other than a bankruptcy proceeding."

TEAM also issued RFIs concerning TNMP's commitment in TNMP's testimony that: "TNMP will maintain an identity, name, and logo that is separate and distinct from the identity, name, and logos associated with Blackstone and any Texas competitive affiliate of TNMP provided that the Blackstone name and logo can be added to the TNMP name and logo for branding purposes".
