Texas Aggregator Applicant Receives Waiver Of PUC Rule Requiring Aggregators To Have Fax Number

In granting the application of Simplified Power Houston LLC for an electric aggregator certificate, the Texas PUC granted Simplified Power Houston LLC a waiver of the current requirement, under the aggregator rules at 16 Texas Administrative Code § 25.111(f)(1), for an aggregator to provide a fax number for a Texas regulatory contact person and for an agent for service of process

For all aggregator types, the PUC aggregator rules require that the applicant provide, "Name, physical business address, telephone number, fax number, and e-mail address for a Texas regulatory contact person and for an agent for service of process, if a different person."

Currently, the waiver only applies in the instant proceeding and to Simplified Power Houston LLC. The aggregator application of Simplified Power Houston LLC was granted via administrative approval, and, as is customary, administrative approval of an uncontested application has no precedential value in a future proceeding.

Applicants (or existing aggregators) seeking similar relief will likely need to specifically seek a similar good cause waiver.

Today, another aggregator applicant made such a request for a waiver; specifically, a request was made by Turnpike Services, Inc. d/b/a Community Energy Solutions

Recently, another aggregator applicant, Ukazim Comfort LLC, had its application found insufficient due to, among other deficiencies, the failure to provide a fax number for the authorized representative or attorney, and for the agent for service of process. Ukazim Comfort LLC had not sought a good cause exception to the fax number rule. The finding of deficiency in the Ukazim Comfort LLC proceeding was made prior to the grant of the waiver in the Simplified Power Houston LLC proceeding.

Simplified Power Houston LLC, which was organized earlier this year, is currently registered as a Texas electric broker. Daniel McCarthy serves as President of Simplified Power Houston LLC. Daniel McCarthy also serves as President of the distinct entity Simplified Power Inc. The entity Simplified Power Inc. currently holds a Texas broker registration and has operated in Texas for decades
