Retail Supplier, Utility Enter Settlement To Resolve Supplier's Complaint Concerning Utility's Reporting Of Usage

Eligo Energy, LLC and Dayton Power and Light (DP&L or AES Ohio) have entered into a settlement to resolve a complaint filed by Eligo Energy against DP&L at the PUC of Ohio over alleged erroneous reporting of Eligo's aggregate usage data by DP&L to PJM
Specific terms of the settlement were not disclosed
Eligo and DP&L stated, "Eligo and AES Ohio have resolved all issues raised in the above-styled complaint and have reached a full and comprehensive settlement satisfactory to all parties. Therefore, by agreement, the parties respectfully request that the Commission dismiss the above-captioned case in its entirety with prejudice, with each party bearing their own costs."
In the initial complaint, Eligo had alleged that the alleged error, "resulted in PJM
requiring Eligo to post significantly more cash collateral with PJM than would otherwise be
required had AES Ohio not reported the wrong usage amounts, to Eligo’s significant detriment."
As one example, Eligo had alleged that, "on September 17, 2025 [sic, 2024] and September 22, 2024, AES reported usage
that was nearly 10 times the average usages across the rest of the month."
In a previously filed answer to the complaint, DP&L had generally admitted the submission of incorrect usage in certain instances, but had generally denied Eligo's characterization of DP&L's process to remedy the problems, and had generally denied allegations from Eligo that DP&L's actions allegedly violated specific rule, tariff, or law
In a previously filed answer to the complaint, DP&L had said, "At all pertinent times, AES Ohio has provided adequate service and
coordination with Eligo in accordance with all applicable provisions of Title 49 of the Ohio
Revised Code and regulations promulgated thereunder, and in accordance with AES Ohio’s
filed tariffs."
