Texas PUC ALJ Dismisses Proceeding Addressing New Nonprofit Co-op Which Seeks To Serve Retail Customers At TDUs Without REP Certificate Or CCN

A Texas PUC ALJ dismissed a proceeding which houses filings from Roshan Energy, which describes itself as a "Nonprofit Electric Cooperative", and which has sought to serve retail electric customers in customer choice territories without Roshan being required to obtain a REP certificate or a CCN.

Roshan Energy had requested confirmation from the Texas PUC that Roshan Energy, as a Chapter 161 electric cooperative, is exempt from REP certification and CCN requirements, and may proceed with retail electric service to its members without further PUCT approval
The ALJ noted that, "In two subsequent filings, filed on
October 24 and November 13, 2025, Roshan Energy has stated its belief that it does not need
certification from the Commission and, therefore, it is appropriate to dismiss this case because it
is not seeking relief."
The ALJ said, "Neither the ALJ nor Commission Staff may provide legal guidance
to Roshan Energy as to whether it needs Commission approval. Such is an impermissible advisory
opinion and this docket may not be used for such purposes."
The ALJ stressed, "This order [on dismissal] should not be construed as a determination that Roshan Energy does not require Commission
approval for activities it seeks to engage in."
"Given that Roshan Energy has now twice indicated it is not seeking any relief by this proceeding
and has requested that it be dismissed, the ALJ finds it appropriate to dismiss this case and close
the docket without prejudice to refiling," the ALJ said
