PUC Proposes Rule Changes For Rate Case Filings (The Issues Subject To Review In Rate Cases, Including Supplier Tariffs, Has Been A Recent Question)

The PUC of Ohio has filed draft rules for revisions to its standard filing requirements for applications from electric and natural gas utilities for delivery rate increases, in light of recent statutory changes

While the draft rules largely relate to provisions governing what must be filed in support of rate cases, including justification and supporting data and testimony, the proceeding is notable given precedent that PUCO does not consider, in rate cases, stakeholder proposals for tariff changes or fee changes for those tariffs/fees that the utility did not propose to change in its rate case application

This precedent has hampered consideration of various retail market and tariff changes sought by retail suppliers via rate cases, such as elimination of switching fees and customer data access fees (see story for background)

While the rulemaking does not squarely govern this precedent about the issues to be considered by PUCO in rate cases, the rulemaking could potentially serve as a forum to, at a minimum, seek a requirement that utilities in rate increase applications shall file justification for all tariff provisions and fees, even those not proposed to be changed, which could then potentially open avenues for consideration of such justification
