PUC Refers Exiting Retail Supplier's Outstanding ACP Balance To Attorney General

The Pennsylvania PUC has revoked the electric generation supplier license of Energo Power & Gas LLC d/b/a Marathon Energy, rather than granting the voluntary relinquishment of the EGS license as requested by Energo
As previously reported, Energo had transferred its electric customers to Constellation at the start of 2024. Energo sought relinquishment of the EGS license since Energo no longer served electric customers in Pennsylvania
However, for its prior period of service, the PUC said that Energo failed to retire enough Alternative Energy Credits (AEC) to satisfy Energo's obligations under the Alternative Energy Portfolio Standards (AEPS) Act.
The PUC said that Energo owed approximately $1.2 million in Alternative Compliance Payments (ACPs).
The PUC drew on a $697,000 letter of credit previously posted by Energo in connection with the EGS license, to partially satisfy the ACP obligation
However, the PUC said that $545,000 in ACP obligations remains outstanding, and the PUC referred the matter to the Pennsylvania Office of Attorney General, "for appropriate action".
Energo provided the following statement concerning the matter: "Energo has a history of working with the PUC to ensure the highest level of compliance. We are reviewing the matter and will respond when we have completed our review."
