PSC Seeks Comments On Implementing Law Requiring Electricity Suppliers To Procure Energy Storage Credits

The Maryland PSC has sought comment on implementing various provisions of 2025's Senate Bill 937 & House Bill 1035 (PUA § 7-1224 - § 7-1229) relating to the mandatory procurement of front-of-the-meter transmission-connected energy storage
§ 7–1226(a)(1) specifies that each "electricity supplier" shall be responsible for purchasing storage capacity credits at a monthly fixed price schedule proportional to the electricity supplier’s capacity obligation, and all PJM capacity market revenue earned by the energy storage project shall be transmitted to the Commission to be held in escrow for distribution to electric companies -- to be refunded or credited to each distribution customer proportional to the electricity supplier’s monthly capacity purchase obligation
The specific storage procurement section of the law does not define the term electricity supplier. Broadly, under the PUA unless otherwise narrowed under a specific section, the term "electricity supplier" broadly, "includes an electric company, an aggregator, a broker, a marketer of electricity, and a person who provides electricity to a commercial or industrial customer in accordance with § 7–506.1 of this article."
However, certain entities defined as electricity suppliers would have no capacity obligation, to the extent such entities are not LSEs in PJM (such as brokers)
In any case, the PSC is seeking comments and recommendations from stakeholders and the electric companies on the implementation of the above-described requirements, including the obligations and the commercial relationship between successful storage applicants, the PSC, the Escrow Account Administrator, and electricity suppliers.
The PSC noted that a similar procurement obligation for electricity suppliers, for offshore wind credits, may be instructive in crafting rules to govern the suppliers' storage procurement obligations, though the PSC noted that there may be differences based on technology and the unique terms for the different solicitations used for offshore wind and storage
