Texas PUC Says Complaints Against REPs Do Not Require Complainant To Be Current Customer, Or Violation To Be Ongoing, For PUC To Have Jurisdiction

During a discussion at today's open meeting, the Texas PUC Commissioners agreed that a formal complaint filed against a retail electric provider does not require that the complainant must be a current customer of the REP at the time of the complaint filing, and does not require that the alleged violation is ongoing, in order for the PUC to have jurisdiction over the complaint

Commissioners generally agreed with previously reported memos from Chair Thomas Gleeson and Commissioner Courtney Hjaltman regarding the matter.

In doing so, the PUC rejected arguments that a formal complaint against a REP must present the PUC with a live controversy in order to be heard by the PUC

With regards to a specific complaint against a REP which prompted the broader question, Commissioners agreed that an evidentiary record should be developed, with Hjaltman noting that, as such record is developed, it may turn out that some of the requested relief sought by the complainant may not be within the PUC's jurisdiction, but Hjaltman said that such question need not be decided at this point.

Commissioners specifically denied an appeal of an ALJ's order which had denied a motion to dismiss a complaint filed against a REP, with the REP's motion to dismiss arguing that there was a lack of available relief from the PUC
