PSC Conditions Grant Of Broker License On Payment Of Penalty

The Maryland PSC granted United American Marketing Corp. an electric broker license conditioned upon the payment of a civil penalty in the amount of $3,067.36
The PSC in its order stated that United American Marketing Corp. had, in the company's application, represented that the company had previously operated in Maryland "on behalf of" (as phrased by the PSC) two retail suppliers between September 19, 2019 and September 3, 2022
The PSC's order states that United American Marketing Corp. represented that the company realized on September 3, 2022 that the company needed to obtain a license (and ceased activity in Maryland on such date), with the company later applying for a license
The PSC stated, "[PSC] Staff’s recommended civil penalty amount of $3,067.36 is appropriate given the nature of the violation, the length of time that United American served Maryland customers without a license, the number of customers affected and amounts charged, as well as the evidence of good faith to achieve compliance after notification of the violation."
The PSC had initiated the case not only to address United American Marketing Corp.'s application, but because the PSC's decision, "could affect other parties besides United American," due to potential precedent and adoption of any specific formula to establish penalty amounts for broker activity without a license
Specifically, PSC Staff, in proposing the penalty amount stated above, had used a formula designed by Staff, with certain weighted coefficients used in the formula filed on a confidential basis.
The PSC in its order conditionally granting a license to United American Marketing Corp. does not address the broader question of whether to require Staff to re-file a non-confidential copy of Staff's penalty formula.
The Commission will address such question in a separate order.
