New York DPS Staff Seek Extension For Report On Number Of ESCO Customers On Month to Month Contracts

Staff of the New York Dept. of Public Service requested an extension of the deadline for Staff to report on the number of ESCO customers served on month-to-month contracts
The PSC had required Staff to develop such a report as part of a November 2025 order on the implementation of revisions to General Business Law (GBL) §349-d, relating to, among other things, material change notices and renewals, including a requirement that any material change, including any rate change (including monthly variable changes), must receive express affirmative customer consent in order for the change to become effective. The PSC had directed in such November order that Staff provide a report on the number of ESCO customers on month to month contracts, by March 1 of each year
DPS Staff said that Staff needs additional time to develop the report, as Staff said that, "DPS Staff is still seeking responses from a number of ESCOs who thus far have failed to respond to Staff’s information request."
Staff sought an extension until March 16, 2026.
