Regulator Issues Show Cause Orders To 41 Retail Suppliers For Alleged Violations, Seeks Fines Of Up To $111,000 Per Supplier

The Illinois Commerce Commission has issued show cause orders to 41 retail electric suppliers directing each supplier to demonstrate why the supplier should not be subject to penalties for alleged violations of various reporting requirements.

While the specific alleged violations differ by supplier, the orders generally allege that a supplier did not comply with various reporting requirements, such as the filing of quarterly Environmental Disclosure Statements in accordance with 83 Ill. Adm. Code 421.30; the filing of a Supplier Diversity Report in accordance with 220 ILCS 5/5-117 for 2022 and 2023; and the submission of the following reports or filings, most of which are required to be filed annually: 1) a Designated Agent Form in accordance with 83 Ill. Adm. Code 215.10; 2) an ARES Kilowatt-hour Report in accordance with 83 Ill. Adm. Code 451.770; 3) a Call Center Information Report in accordance with 83 Ill Adm. Code 410.45; 4) a Net Metering Report in accordance with 83 Ill. Adm. Code 465.40; 5) Annual Compliance Certification Report in accordance with 83 Ill. Adm. Code 451.710; 6) Annual Rate Report in accordance with 220 ILCS 5/16-115A(a)(iii); and 7) Annual Compliance with Retail Charge Provisions of the Renewable Energy Portfolio Standard (REPS Report) in accordance with 83 Ill. Adm. Code 455.125

Active retail suppliers were among the suppliers to which a show cause order was issued

Fines proposed by ICC Staff vary by supplier, but include a proposed fine of $111,500 for one supplier. More than half of the proposed fines are at or above $20,000, with most of such in the $20,000 to $57,000 range. Proposed fines are as low as $500. Proposed fines are generally based on the number and type of allegedly non-filed report(s)
