New York DPS Staff Receive Extension For Report On Number Of ESCO Customers On Month To Month Contracts

The Secretary of the New York PSC granted Staff of the New York Dept. of Public Service an extension of the deadline for Staff to report on the number of ESCO customers served on month-to-month contracts
The PSC had required Staff to develop such a report as part of a November 2025 order on the implementation of revisions to General Business Law (GBL) §349-d, relating to, among other things, material change notices and renewals, including a requirement that any material change, including any rate change (including monthly variable changes), must receive express affirmative customer consent in order for the change to become effective. The PSC had directed in such November order that Staff provide a report on the number of ESCO customers on month to month contracts, by March 1 of each year
Staff had sought an extension until March 16, 2026, with the Secretary granting an extension until such date
