PUC Posts Draft Changes To Utility Affiliate Rules

The PUC of Ohio has issued for public comment draft changes to the electric utility affiliate rules, under a customary five-year rule review process
PUCO does not propose any material changes governing the electric utility affiliate rules
In the only non-ministerial change, PUCO proposes to revise language which currently states that nothing in the affiliate rules shall be construed as prohibiting or otherwise impeding an electric
utility's ability to conduct activities pursuant certain specific rules governing reasonable arrangements (essentially special contracts between EDCs and specific customers); specifically, the specific reasonable arrangement provisions at OAC 4901:1-38-03 to 4901:1-38-05
Under the draft, the affiliate rule would instead provide that nothing in the affiliate rules shall be construed as prohibiting or otherwise impeding an electric
utility's ability to conduct activities pursuant to any of the rules governing reasonable arrangements under OAC 4901:1-38 (as opposed to only the subparts OAC 4901:1-38-03 to 4901:1-38-05)
