Regulator Issues Fines To Several Retail Suppliers, Dismisses Other Proposed Fines Against Suppliers, As Alleged Non-compliance Stemmed From "Clerical Errors" In Regulator's Records

The Illinois Commerce Commission adopted agreed fines for several retail electric suppliers related to alleged failures to file various compliance reports, but dismissed several other show cause orders against other suppliers after determining that "clerical errors" by the ICC clerk's office had resulted in the erroneous appearance of the reports having not been filed, when such reports had, in fact, been filed by the suppliers
The ICC adopted an agreed order under which Palmco Power, LLC shall pay $7,500 for alleged failure to file, on two occasions, an annual RPS compliance report. The $7,500 fine reflects a 50% reduction to a revised amount proposed by ICC Staff, in light of Palmco filing the reports by a subsequent deadline. Notably, ICC Staff had originally alleged that Palmco had failed to file an annual call center report due in 2023, but Palmco provided evidence demonstrating that the call center report had been filed, and no fine was issued related to any call center report allegation. The ICC adopted an agreed order under which Frontier Utilities Northeast, LLC shall pay $5,750 for alleged failure to file an Annual Compliance Certification Report due in 2024, and three quarterly Environmental Disclosure Statements due during 2023 and 2024. The $5,750 fine reflects a 50% reduction to a revised amount proposed by ICC Staff, in light of Frontier filing the reports by a subsequent deadline. Notably, ICC Staff had originally alleged that Frontier had failed to file an annual rate report due in 2023, but Frontier provided evidence demonstrating that the rate report had been filed, and no fine was issued related to any rate report allegation. The ICC adopted an agreed order under which BP Energy Retail Company LLC shall pay $5,000 for alleged failure to file an Annual Compliance Certification Report in 2023. The $5,000 fine reflects a 50% reduction to a revised amount proposed by ICC Staff, in light of BP Energy Retail Company filing the report by a subsequent deadline. Notably, ICC Staff had originally alleged that BP Energy Retail Company had failed to file an Annual Company Call Center Information Report and an Annual Supplier Diversity Report, but BP Energy Retail Company provided evidence demonstrating that such reports had been filed, and no fine was issued related to allegations concerning these reports. A draft agreed order had stated, "Due to
clerical errors in the Office of the Chief Clerk, these reports [call center and diversity] were not shown as filed by

The ICC adopted an agreed order under which Energy Services Providers, LLC shall pay $3,750 for alleged failure to file an Annual Retail Charge Provisions of the Renewable Energy Portfolio Report in 2023. The $3,750 fine reflects a 50% reduction to an amount proposed by ICC Staff, in light of Energy Services Providers filing the report by a subsequent deadline. Energy Services Providers, LLC had argued that the report was timely filed, but acknowledged that the report was filed under the name of the entity Energy Services Providers, LLC, rather than the name of Energy Services Providers Inc., with the "Inc." name being the name under which the ARES license was held when the report was filed, preventing the report from being correctly filed by the ICC clerk. The ICC adopted an agreed order under which a prior show cause order issued against Spark Energy, LLC is dismissed. The prior show cause order had alleged failure to file certain compliance reports. A draft agreed order had stated, "Staff stated that the Office of the Chief Clerk had
found the missing reports that were initially filed on time by Spark". ICC Staff had originally sought a total penalty of $10,000, but withdrew such recommendation, and the case was dismissed with no penalties imposed and with the allegations dismissed

The ICC adopted an agreed order under which a prior show cause order issued against Ambit Northeast, LLC is dismissed. The prior show cause order had alleged failure to file certain compliance reports. A draft agreed order had stated, "Staff stated that the Office of the Chief Clerk had
found the missing reports that were initially filed on time by Ambit." ICC Staff had originally sought a total penalty of $7,500, but withdrew such recommendation, and the case was dismissed with no penalties imposed and with the allegations dismissed

The ICC adopted an agreed order under which a prior show cause order issued against Vista Energy Marketing is dismissed. The prior show cause order had alleged failure to file certain compliance reports. A draft agreed order had stated, "Staff stated that the Office of the Chief Cleark [sic] had
found the missing reports; they had been filed as a group and thus were not logged
individually." ICC Staff had originally sought a total penalty of $22,500, but withdrew such recommendation, and the case was dismissed with no penalties issued and with the allegations dismissed

The ICC adopted an agreed order under which a prior show cause order issued against MidAmerican Energy Services, LLC is dismissed. The prior show cause order had alleged failure to file certain compliance reports. A draft agreed order had stated, "The reports at issue were properly filed with the Commission by the applicable deadlines, but due to clerical errors in the Office of the Chief Clerk, the reports were associated with an incorrect entity name, resulting in the reports not being identified by Staff as having been filed on behalf of MidAmerican Energy Services, LLC." ICC Staff had originally sought a total penalty of $17,500, but withdrew such recommendation, and the case was dismissed with no penalties imposed and with the allegations dismissed
