The PUC of Ohio has issued proposed changes to Ohio Adm.Code Chapter 4901:1-38, governing reasonable arrangements, as part of a customary 5-year rule review.

Reasonable arrangements are special agreements between utilities and certain customers, and in the past have been used to allow for utility-developed generation. While recent Ohio statutory changes ostensibly do not allow electric distribution utilities to own or operate generation, reasonable arrangements may still implicate other competitive issues, particularly if a utility affiliate is involved, including siting for large loads and grid topography.

Additionally, as noted in a story published by ECM today, reasonable arrangements may address the ability of a customer to shop for competitive electric supply

A substantive change proposed in the PUC draft rules is eliminating the current ability for non-mercantile customers to enter into reasonable arrangements, instead limiting reasonable arrangements to mercantile customers
