Agreement Between Utility & Amazon Requires That, If Amazon Load Is Included In Default Service Auction, Then Amazon Shall Maintain Such Load On Default Service Until Procured SSO Contracts Expire

Duke Energy Ohio has sought from the PUC of Ohio approval of a reasonable arrangement with Amazon Data Services, Inc. that, while requiring Amazon to be supplied by a competitive retail electric supplier, would also require that, if Amazon's related load is included in default service, Amazon shall maintain such load in default service until the expiration of any default service contracts that were procured to serve such load
The proposed reasonable arrangement would govern electric service to Amazon's new data center at the
Trenton Industrial Park, located in the City of Trenton in Butler County, Ohio.
The contract between Duke and Amazon states, "Customer shall contract with a certified third-party
supplier for retail electric generation service to the extent permitted by Ohio law and Duke
Energy’s Electric Tariff. Unless an alternative process is approved by the Public Utilities
Commission of Ohio, in the event Customer must receive its retail electric generation service under
Duke Energy’s Standard Service Offer ('SSO') due to supplier default or other reasons beyond
Customer’s control, Customer agrees to use its best efforts to contract for retail electric generation
service from a competitive supplier as soon as practical. In the event Customer is being served by Duke Energy’s SSO and Customer’s load is included in Duke Energy’s SSO procurement auction,
Customer agrees to remain an SSO customer and continue to receive such SSO service until the
end of the period for which Duke Energy has procured supply for its SSO customers."
