Utilities Seek Temporary Waiver Of Rule Which Contemplates New EDI Transaction For Default Service Drop Requests

The FirstEnergy Ohio utilities have requested, if needed, a temporary waiver of newly adopted Ohio Adm.Code 4901:1-21-21(A), governing the expedited return of mercantile customers to electricity default service, to the extent the rule is interpreted as requiring that an EDI transaction cited in the rule's language must be available on the rule's effective date, which is July 17, 2026

New Ohio Adm.Code 4901:1-21-21(A) provides that a request from a retail electric supplier, on behalf of a mercantile customer, for an expedited return of the customer to default service shall be made via a form developed by PUCO, "or an equivalent EDI transaction".
To the extent the electronic data interchange (EDI) transaction referenced in Ohio Adm.Code 4901:1-21-21(A) is required to be available on July 17, 2026, the FirstEnergy Ohio EDCs sought a temporary waiver to provide the EDCs with adequate time to develop the EDI transaction and coordinate such through the EDI working group.
Until (and after) the EDI transaction is available, the FirstEnergy Ohio utilities said that the FirstEnergy Ohio utilities will be able to receive and process any requests for an expedited return of a mercantile customer to the SSO made using the PUCO form
The FirstEnergy Ohio utilities noted that the EDI transaction referenced in Ohio Adm.Code 4901:1-21-21(A) is not mandated by statute
PUCO, in adopting the new rules, had noted that utilities may require additional time to implement necessary system changes, and stated that to the extent an EDC believes such time is needed, that EDC can seek a temporary waiver supported by good cause
