D.C. Budget-Related Bill Enacted Without Retail Energy Price Caps, Other Retail Market Provisions

The enrolled version of the District of Columbia Budget Support Act (D.C. Bill 26-661) has been enacted, without the Mayor's signature, as Act Number A26-0418
The bill remains subject to federal congressional review prior to becoming final law
As first reported by EnergyChoiceMatters.com, the enrolled version of the bill struck in its entirety a prior section (Subtitle E) which would have imposed various restrictions on retail energy choice, including price caps
The administration of D.C. Mayor Muriel Bowser, via the DC Department of Energy & Environment, had previously proposed various retail energy reform options similar to those in Maryland and other states, including price caps
Regardless of the reforms being excluded from the enacted budget bill, the Bowser administration and Council have expressed concerns with the current retail energy market and the current state of existing consumer protections, and such matters will continue to be subject to review by policymakers through other avenues

Most notably, the struck language had proposed to require that the PSC shall establish "one or more price caps" for electricity (and gas) supplied by a market participant to residential customers
The struck language would have provided that an existing contract that contains a price for supply that exceeds an applicable price cap, "shall [b]e deemed null and void as against public policy[.]"
