Retail Supplier To Pay $28,000 Under Pennsylvania Settlement To Resolve Alleged Slamming

Spartacus Energy Services, LLC would pay $28,000 under a settlement with the Pennsylvania PUC's Bureau of Investigation and Enforcement to resolve alleged instances of slamming

The settlement states that, since December of 2023, the Pennsylvania Public Utility Commission’s Bureau of Consumer Services (“BCS”) has received approximately forty (40) complaints from individuals who claim that their electricity supplier was switched without authorization to Spartacus

Based on such complaints, I&E was prepared to allege that approximately forty (40) customers had their electricity supplier switched without authorization to Spartacus

The settlement states that all of the at-issue enrollments were from a single, specific third-party vendor used by Spartacus, who Spartacus "promptly" suspended and then terminated upon becoming aware of the issue, the settlement states

In a statement filed with the Pa. PUC in support of of the settlement, Spartacus states, "This settlement relates to enrollments performed by a third-party marketing vendor conducting commercial sales on behalf Spartacus. All of the enrollments in question were commercial customers whose enrollments were submitted by the vendor as in-person enrollments, based on digitally signed enrollment confirmations."

In a statement filed with the Pa. PUC in support of of the settlement, Spartacus states, "On January 9, 2024, approximately 27 days after the vendor began marketing, Spartacus received a complaint from a customer disputing an enrollment. Spartacus contacted the vendor to express its concerns with the vendor's processes. Shortly thereafter, Spartacus received additional complaints regarding enrollments performed by the vendor. Upon receiving these additional complaints, Spartacus suspended the vendor's operations on January 22, 2024 and formally terminated the vendor on January 31, 2024."

I&E noted that, "Spartacus ... promptly addressed the misconduct committed by its agent by terminating its contract with [such agent], prior to the initiation of I&E’s informal investigation."

Spartacus ceased service to the affected customers (or canceled their enrollment if still pending) and provided "complete" refunds of supplier charges. Spartacus said in a filing that, "Spartacus took all of these [corrective] actions and terminated the vendor long before being contacted by I&E."

Spartacus has implemented a two-point sales verification process to guarantee that all future enrollments are authorized before they are integrated into Spartacus’s platform

Spartacus does not admit to any violations of laws or regulations under the settlement

The settlement states, "The Parties agree that the underlying allegations were not the subject of any hearing and that there has been no Order, findings of fact, or conclusions of law rendered in this Complaint proceeding. It is further understood that, by entering into this Settlement Agreement, Spartacus has made no concession or admission of fact or law and may dispute all issues of fact and law for all purposes in any other proceeding, including but not limited to any civil proceedings, that may arise as a result of the circumstances described in this Joint Settlement Petition, nor may this Settlement be used by any other person or entity as a concession or admission of fact or law."
