Regulator Issues Fines To Several Retail Suppliers Under Agreed Orders

The Illinois Commerce Commission adopted several additional agreed orders between various retail electric suppliers and ICC Staff requiring the suppliers to make various agreed payments for alleged failure to file various reports or other filings, as described below
The payments are generally 50% lower than an initially proposed fine from ICC Staff for each supplier, reflecting that the suppliers have since come into compliance with the relevant obligations.
CPV Retail Energy LP is to pay $6,250 to resolve alleged failures to file: an
Annual Company Call Center Information Report in accordance with 83 Ill. Adm.
Code 410.45 by March 1, 2024; a Net Metering Report in accordance with 83 Ill. Admin. Code 465.40 by April 1, 2024; and a Designated Agent Form in accordance with 83 Ill. Adm. Code 215.10 by January
31, 2024 (Docket 26-0198).
AP Gas & Electric (IL), LLC is to pay $5,000 to resolve an alleged failure to file an Annual Rate Report in accordance with 220 ILCS 5/16-115A(a)(iii) by June 30,
2024 (Docket 26-0200).
Constellation NewEnergy, Inc. is to pay $1,250 to resolve an alleged failure to file an Annual Supplier Diversity Report in accordance with 220 ILCS 5/16-111.11 by
June 1, 2024. According to an agreed draft order, Constellation NewEnergy, Inc., "provided evidence that the
underlying report [Annual Supplier Diversity Report] had been received by the Comission [sic] in a timely fashion but had been
filed with the Commission under a different Constellation entity name." Constellation NewEnergy agreed to a $1,250 payment in lieu of further litigation. Originally, ICC Staff had alleged that Constellation NewEnergy had also failed to file an Annual Company Call Center Information Report by March 1, 2023, but Constellation NewEnergy provided evidence that the Call Center Information Report was received by the ICC Clerk’s office on February 27, 2023, and ICC Staff withdrew a previously recommended fine associated with the Call Center Information Report (Docket 26-0201).
