PUC Staff Supports Utility's Sought (Brief) Total Waiver Of Rule Which Requires Expedited Returns To Default Service; Longer Waiver For Accomplishing Such Via EDI

Staff of the PUC of Ohio have recommended approval of Duke Energy Ohio's request for a brief waiver of the new requirement -- regardless of mechanism -- to complete an expedited return of a mercantile customer to electricity default service
As previously reported, new Ohio Adm.Code 4901:1-21-21(A) provides that a request from a retail electric supplier, on behalf of a mercantile customer, for an expedited return of the customer to default service shall be made via a form developed by PUCO, "or an equivalent EDI transaction," and shall be completed by the EDC within three business days
As previously reported by ECM, several utilities have requested temporary waivers of the requirement of the rule to complete expedited returns via EDI, until such time as a new EDI mechanism is implemented for expedited returns
Duke's requested waiver is notable in that, unlike the other EDCs which have thus far requested a waiver limited to EDI (with compliance via manual expedited drops immediately available as of the rule's effective date), Duke has said that a brief period is needed for Duke to implement a manual process for expedited returns, and Duke has sought a brief waiver of the 3-business-day expedited return requirement, whether via EDI or manual process, until the manual process is developed
Specifically, Duke sought through October 19, 2026 a waiver of the requirement to complete a mercantile customer's expedited return within three business days
Duke then sought a waiver until June 30, 2027 of any requirement to accomplish the expedited returns via an EDI transaction. Pending testing of the manual process described above, Duke would accomplish the returns during this EDI-waiver period within 3 business days via the non-EDI manual process
In recommending approval of both of Duke's sought waivers, PUCO Staff said, "Staff has reviewed the Company's request for a temporary limited waivers and find the
request to be reasonable."
"Staff will continue to monitor the EDI Working Group to ensure
process towards implementation," Staff said
