New York PSC Issues Show Cause Order To ESCO

The New York PSC issued a show cause order to True Source Power LLC (True Source), an applicant for eligibility as an ESCO, as the PSC directed True Source Power to show why True Source's application for eligibility to
operate as an ESCO in New York State should not be denied.

As summarized by the PSC, Dept. of Public Service (DPS) Staff have alleged a, "web of seemingly
related individuals and ESCOs connected to True Source that have
been accused of or were found to have engaged in problematic
business practices and marketing tactics."
The PSC in its order noted that, "an
individual named Ebere Goodluck had signed the Company’s [True Source's] ESCO eligibility application in their capacity as President of True
Source."
The PSC said in its order that, "OCS [Office of Consumer Services] staff recognized this name as potentially connected
to SunSea Energy LLC (SunSea), an ESCO that previously operated
in New York State and whose eligibility the Commission revoked
in 2021. OCS staff then reviewed SunSea’s 2017 RAAF and 2023
triennial filing and confirmed that SunSea listed Ebere
Goodluck as its 'Primary Regulatory Complaint Manager' in both
documents."
The PSC in its order also stated that, "During an enforcement proceeding that the Maryland Public
Service Commission brought against SunSea, SunSea’s
President, Jacob Adigwe, testified to hiring 'Ebere
Goodluck as the new Vice President of SunSea Energy.'"
The PSC further noted that, as previously reported, the PSC in July 2026 issued an order to show cause to ESCO Star Light and Power LLC concerning alleged slamming
The PSC said that, in the order to show cause issued to Star Light and Power LLC, Department of Public Service (DPS) Staff, "outlined apparent
connections between Star Light, SunSea, and other ESCOs and
individuals."
Summarizing an OCS Staff position, the PSC said in its show cause order, "given SunSea’s established record of
sanctions in New York State and the allegations outlined in the
Star Light OTSC [order to show cause], OCS staff was concerned that SunSea and Star
Light could be using True Source to improperly absorb customers
from and continue those entities’ businesses."
Summarizing a review by the DPS's Office of Investigations and
Enforcement (OIE), the PSC said, "Ebere Goodluck’s LinkedIn page represents that they are a
sales representative for a marketing company called EZE
Sales & Marketing Inc. SunSea listed EZE Sales, Inc. as
one of its third-party marketing vendors in a 2020 report
that SunSea filed with OCS staff, while Star Light listed
EZE Sales as one of its marketers in attachments to its
2023 RAAF."
As summarized by the PSC, Dept. of Public Service (DPS) Staff has alleged that one of the
"interconnected" ESCOs to True Source, called New England Power and Light, "also apparently attempted to mislead
regulators in Massachusetts when applying to obtain a license to
operate in that state."
As summarized by the PSC, Dept. of Public Service (DPS) Staff has alleged, "It further appears that True Source is
currently (and incorrectly) asserting on its public website that
it is eligible to operate in New York State, even though it is
not."
As summarized by the PSC, "Staff therefore alleges that 'senior management' of True
Source 'has been engaged in, or has worked for ESCOs that have
engaged in, violations of law, regulations or rules.'30 Staff
further contends that True Source 'is not likely to comply with
the UBP if the ESCO were deemed eligible.'"
