Utilities File New Time Of Use Default Service Options

Pursuant to recent legislation, Commonwealth Edison and Ameren Illinois have each filed tariffs with the Illinois Commerce Commission to implement new time of use default service electricity rate options
Section 16-107.8 under P.A. 104-0458 requires the utilities to offer a "market-based" TOU option that has at least three TOU periods (a peak, off-peak, and super off-peak period). The new TOU option is distinct from the current optional hourly pricing program for default service
At ComEd, the eligibility for existing Rate BEST, a TOU default service option with 4 TOU periods (morning, mid-day peak, evening, and overnight) which is currently available to residential customers, would be expanded to non-residential customers which are under 100 kW (the class of non-residential customers which has not been "competitively declared" by the ICC, and for whom the default option for utility supply is a fixed rate)
Rate BEST would be open to such non-residential customers starting in January 2028
Additionally, pursuant to the legislation, starting in January 2028 for all Rate BEST customers, the kW-based costs for transmission service and other kW-based PJM-associated expenses incurred by ComEd will be recovered from Rate BEST customers through a kWh-based charge applicable to kilowatt-hours delivered to the customer during the Mid-Day Peak Period and designated accordingly as a separate line item on the customer’s monthly bill for electric service. The other kWh-based transmission service costs, and other PJM-associated expenses, will be recovered from customers through a kWh-based charge applicable to all four TOU periods.
Ameren proposes a new default service option of Rider STOU - Supply Time-of-Use, available to customers on service classes DS-1 (Residential) and DS-2 (Small General Service)
Rider STOU would have 3 TOU periods: off-peak, intermediate, and on-peak.
Ameren's proposed tariff includes the ability to update Rider STOU as follows: "The determination and application of the Rider STOU charges allow the Company to recover from Customers the cost the Company incurs in procuring all the services it requires to meet such Customers' electric power and energy requirements at any given time. The Company will file, at a minimum, a Rider STOU informational filing at least two weeks prior to the effective date in June and again at least two weeks prior to the effective date in October. Notwithstanding such periodic updates, the Rider STOU informational filing may be revised by the Company if the Company determines such revision results in a better match between the Company's applicable expected costs and its recovery of those costs. Additionally, the Company shall be entitled to change the STOU Periods annually to better reflect the system peak periods, provided Customers receive at least two weeks advance notice."
For Rider STOU customers, the Transmission Service Charge would be a rate in ¢/kWh meant to collect the cost of Transmission Service charges applied to all kWh on the on-peak block for the applicable effective month.
Ameren's proposed Rider STOU tariff has a proposed effective date of November 13, 2026
While the filings include formulas to establish the TOU default service rates, actual prices for the new TOU options would be set at a later date under separate tariff informational sheets
