Update: Large Pennsylvania Utility's Scope Of Work, That Led To Pending Affiliate Contract For Customer-Facing Services, Noted That EDC Sought Assistance Because Services Were, "Outside Of The Responsibility For An Electrical Distribution Company"

In a proceeding in which Duquesne Light Company (DLC) has petitioned the Pennsylvania PUC for approval of an Affiliate Services Agreement between Duquesne Light Company and its affiliate The Efficient Network (TEN), DLC has filed a general scope of work that had been included in the procurement solicitation which DLC had conducted to seek, "a professional energy consultant to provide customer-facing consulting services, technical guidance, engineering support, etc. to inform, develop, and execute new customer projects involving edge of the grid technologies (i.e., solar, battery storage, EV, etc.)."
As previously reported, in seeking this type of consultation, Duquesne Light Company has said that eight service providers were invited to participate. Of those eight, four submitted a formal bid. Duquesne Light Company (DLC) said in a new PUC filing that the agreement is designed to be used on an ad-hoc basis, and a specific scope of work would be generated and
signed for each project as needed. No such scopes of work exist yet, DLC said
However, DLC filed with the PUC the general scope of work
that had been included in the procurement solicitation
Notably, this general scope of work stated, "DLC frequently works with potential applicants for electrical service to optimize their
building infrastructure design to achieve the objectives that are primary to the applicant.
During these conversations, DLC is unable to provide advice about many aspects of a
project because it is outside of the responsibility for an electrical distribution company
(EDC)."
This general scope of work stated, "DLC would like to have a contracted energy services provider available to its
project teams so that a 3rd party expert can provide advice about non-DLC scopes of
work within an applicant’s project."
This general scope of work listed the Scope of Work to be performed & Project Deliverables as follows:
• Develop a standard list of project offerings that can be presented to any project
applicant.
• Provide consulting services upon request from DLC and the applicant to answer
questions related to a specific proposed project.
• Provide technical references, engineering studies, cost estimates, construction
schedules, etc. as needed or requested by the applicant to support their project
• Provide consulting services to existing DLC customers that are investigating
expanding or establishing new electrical services
The general scope of work also states, "DLC’s interest is in providing its customers with the best products and services at the
most affordable rates possible."
The general scope of work states, "The successful Bidder will be able to support DLC in providing ideation, project
development, energy analysis, business case justification, engineering design,
construction, performance guarantees, and measurement and verification services to
DLC customers. Additional consideration will be given to those firms able to provide or
arrange financing and help DLC customers secure grants to implement energy
infrastructure, efficiency, decarbonization, and electrification projects."
As stated in the general scope of work, "This RFP is for a continuous, three-year engagement period with services provided by
the winning bidder as called upon by DLC and its applicants and customers."
