Amendment To Texas REP Certificate Of EE REP 2, LLC Approved

The Texas PUC granted final approval to the application of EE REP 2, LLC to amend its retail electric provider certificate to: reflect a change in ownership or control; a name change from MI Texas REP 2, LLC to EE REP 2, LLC; and a change in technical and managerial qualifications
As first reported by EnergyChoiceMatters.com, as of September 1, 2025, MI Texas REP 2, LLC experienced a change in ownership and control. The new owner and direct parent company of MI Texas REP 2, LLC is Elevate Energy, LLC (which holds Texas REP Certificate No. 10353 and which is part of Energywell)
As previously reported, during the REP certificate amendment process, PUC Staff had initially opposed the amendment, with PUC Staff alleging that, "the application relies on persons prohibited from exercising control [of a REP] under 16 TAC § 25.107(g)(1)(A) to meet the requirements of subsections (d) and (e) [of the certification rules, relating to prior energy market experience]."
While EE REP 2, LLC contested Staff's interpretation of the relevant individuals' CVs vis-a-vis the applicable rule, EE REP 2, LLC ultimately revised the amendment application to rely on different individuals to meet the rules' requirements for individuals with the requisite prior energy market experience. With such change, Staff recommended approval of the amendment
As a result of changing the individuals used to meet the rules' prior experience requirements, the PUC did not address Staff's arguments concerning whether certain employment positions or responsibilities constitute being a "principal" of a REP, and thus no additional precedent on the matter was set
