Customer Withdraws Formal Complaint At Texas PUC Concerning VPP Retail Plan Marketing; Requests PUC's Enforcement Division Investigate Matter

The customer complainant who had filed a formal complaint at the Texas PUC against Tesla Energy Ventures, LLC d/b/a Tesla Electric ("Tesla") concerning Tesla Electric's control over, and decision-making concerning the level of charge for, the customer's Powerwall, and the marketing of an associated retail electric plan, has withdrawn the formal complaint
The complainant has instead requested that the alleged behavior be investigated by the PUC's Division of Compliance and Enforcement (DICE), with the complainant not being a party to any DICE investigation and potential future enforcement action

The complaint against Tesla Electric, related to its VPP and retail plan, had been notable not only due to the novelty of a VPP-associated retail plan formal complaint, and the potential for litigation of such to set precedent, but also because, rather than alleging any violation of the VPP plan terms of service, the complainant had alleged that Tesla Electric's actual reservation of Powerwall power, for potential grid dispatch rather than customer use, should have been accounted for in disclosing the cost (or potential cost) of the plan. The complaint had alleged that the lack of any disclosure in marketing materials of the financial risk associated with Tesla Electric's decisions on maintaining a higher Powerwall charge, requiring the customer to pay for grid power, is misleading

Rather than a formal complaint proceeding which is generally public, the matter is now set to be referred to DICE, whose reviews are generally not public unless DICE determines, after its review, that a formal enforcement action is appropriate, at which time a formal public proceeding is initiated
