State's House Passes Bill Which Includes Price Cap For Certain Electric Customers

The Ohio House of Representatives recently passed HB 173 which relates to the provision of submetered electricity service, and which includes a price cap for such service
Specifically, HB 173 would provide that a provider reselling electricity via submetered service to a "tenant", based on metered consumption, may not charge more than the cost under the standard service offer (SSO) and all other utility charges that would otherwise be applicable
Due to the use of the term tenant and the specific reference to a definition in an existing section of the Ohio Revised Code, the price cap is only applicable to service to submetered residential consumers of electricity (as a tenant is specifically defined as the occupant of a residential premise)
As previously reported, PUCO by order had previously adopted a price cap equal to the SSO for submetered service, but HB 173 would make such provision statutory
Submetered customers generally cannot select a retail supplier. The customer at the master meter is generally able to choose a competitive supplier
Additionally, HB 173 would require each electric utility to maintain tools on the utility's website, "that permit
automatic calculation of what the electric utility would charge
its residential customers with a specific kilowatt-hour usage
during any of the most recent twelve months."
HB 173 does not explicitly require that such tool list the cost for individual components of the bill (i.e., the SSO)
The Ohio EDCs have varying levels of bill calculators on their websites currently; certain EDCs require the download of a spreadsheet, and some calculators require additional input other than a single monthly kWh total
HB 173 has been referred to a Senate committee
