Retail Supplier, Township, & Protesting Consultant Reach Settlement On Municipal Aggregation Certification, Agreement Addresses Brokerage Fees

Eastern Power and Gas, LLC, Palmer Energy Company, Inc., and Newton Township, Ohio have reached a settlement concerning Newton Township's certification by the PUC of Ohio as a governmental aggregator
As previously reported, Palmer had alleged that Newton Township did not complete several steps required for certification as a governmental aggregator, with Palmer alleging that Newton was improperly relying on a prior vote for non-Township areas as authorization for Newton's opt-out authority. The case is unusual because Newton Township received certification as a governmental aggregator from PUCO via the automatic 30-day process, but Palmer sought rehearing of such automatic approval, with such rehearing being granted as previously reported

Under the stipulation, the Newton Township CCA will be permitted to continue through December 5, 2026, including Newton's existing supply contract with Eastern. For service beyond December 5, 2026, Newton will conduct a Township-specific vote and will re-seek a governmental aggregator certificate from PUCO
The stipulation provides, "Palmer shall be the exclusive aggregator/broker under the supply contract for the Newton aggregation program -as [sic] defined in a separate agreement between Eastern and Palmer, and brokerage fees under the Newton aggregation program shall not be paid to any other brokers."
The stipulation provides, "Going forward, Eastern will refrain from serving any new governmental aggregators until at least thirty days has passed since the new aggregator’s governmental aggregation certificate has been approved".
The stipulation makes no reference to Buckeye Energy Brokers, which has served as a consultant for Newton Township, and which had filed comments in opposition to Palmer Energy Company's protest
