Maryland Legislature Sends To Governor Bill Changing Level For Residential Rate Caps Applicable To Retail Electric Suppliers

Both the Maryland House and Senate have passed a conference committee version of HB 1532 which, among other things, modifies the current rate caps for residential retail electric service for non-green products
The bill awaits action by the governor
Under current law, residential electric rates from retail suppliers may not exceed the trailing 12-month average SOS rate
HB 1532 modifies the cap to be based on a percentage of the SOS rate in effect "as of the date of agreement with the customer", with the cap varying depending on a fixed plan's term length
Specifically, a retail electric supplier would be permitted to offer a residential customer a fixed plan, for a term not longer than 23 months, that has a rate at or below 100% of the current SOS rate at the time contracting
A retail electric supplier would be permitted to offer a residential customer a fixed plan, for a term of 24 months to 35 months, that has a rate at or below 105% of the current SOS rate at the time contracting
A retail electric supplier would be permitted to offer a residential customer a fixed plan, for a term of 36 months, that has a rate at or below 110% of the current SOS rate at the time contracting
A retail electric supplier would be permitted to offer a variable rate to residential customers provided that the supplier's rate never exceeds that SOS rate at any time during service to the customer
As intimated from the provisions above, HB 1532 would modify the current term length limit of 12 months for non-green residential electric contracts, with the bill instead providing that residential retail supplier agreements may not exceed 36 months in length
HB 1532 does not modify any of the existing statutory language prohibiting utilities from purchasing the receivables of retail suppliers related to residential service
