PUC Fines Retail Suppliers, Brokers Who Have Failed To File Annual Report

The PUC of Ohio has issued a list of retail energy suppliers, brokers, and similar entities which are found by PUCO to have not filed a 2023 and/or 2024 annual report for fiscal assessment, with PUCO ordering that a $1,000 civil forfeiture be imposed on each listed entity
More than two dozen retail suppliers and brokers are listed by PUCO as being subject to the fine, with many of such entities understood to be active.

The effective date for the $1,000 fine is tolled for 30 days to allow listed entities to seek rehearing
PUCO's introductory narrative in the order does inject some ambiguity by stating that the civil forfeiture of $1,000 is imposed, "against every company listed in the attachments to this Finding and Order that fails to comply with this Finding and Order," suggesting that the fine will not be imposed on an entity that comes into compliance under the order by a stated deadline (essentially with the entity meeting a last-chance deadline)
However, the substantive portion of the order states that the $1,000 fine is being assessed at this time by the order, regardless of any future filing by an entity (though an entity may seek waiver of the fine via rehearing, as is common).
Specifically, the order states, "As each of the companies listed in the attachments to this Finding and Order have failed to submit a 2023 and/or a 2024 annual report by the April 26, 2024 or April 30, 2025 deadlines, as applicable, the Commission directs Staff to assess a civil forfeiture of $1,000 on these companies pursuant to R.C. 4905.54 for the failure to file a 2023 and/or 2024 annual report".
Furthermore, the ordering paragraph is explicit that, "It is, therefore, ORDERED ... That Staff assess a $1,000 civil forfeiture against each entity listed in the attachments to this Finding and Order," with such assessment not conditioned on any continued non-compliance in response to the order
PUCO warned that further fines may be imposed if the entities do not file the required reports by May 14, 2026
