PUC Staff Recommend Approval Of Retail Supplier's Application To Re-enter State, With Service Limited To Large Non-residential Customers

Staff of the PUC of Ohio have recommended approval of the application of Palmco Power OH, LLC for a retail electricity supplier license, and approval of the application of Palmco Energy OH, LLC for a retail natural gas supplier license, with such licenses limited to providing marketer (supplier) and brokerage services to, "large commercial and industrial customers."
Staff's proposed grant of licensure is generally in line with the authority sought by Palmco, though, due to the unique customer categories for each commodity type on the application form, Palmco's selected authority differed in terminology (for example, because the electricity application does not distinguish between "small commercial" and "large commercial" authority, with only a "commercial" option, Palmco had applied to serve, for electricity, industrial and mercantile customers)
As previously reported, Palmco had exited the Ohio market and was subject to certain stay-out provisions under two settlements to resolve alleged violations
One of the provisions of a 2019 settlement was that PALMco’s then-current owners agreed not to operate as an owner, officer, director, or partner for another competitive retail electric service (CRES) "company" or competitive retail natural gas service (CRNGS) "company" (which would include a retail supplier, broker, marketer, or aggregator) in Ohio for five years from the signing of the stipulation. The settlement was signed on July 31, 2019 and thus this stay-out period for a CRES/CRNGS "company" has expired
In 2021, PALMco entered into a second settlement addressing various allegations of allegedly deceptive marketing, covering a different time period than the earlier settlement. In such 2021 settlement, PALMco agreed that its then-current owners will not serve as an owner, officer, director, or partner for a competitive retail electric service "supplier" or a competitive retail natural gas service "supplier" in Ohio for a period of seven years from October 20, 2021, except that PALMco's then-current owners would be permitted, after July 31, 2024, to serve as as an owner, officer, director, or partner for an Ohio retail supplier if such supplier, "serves only large commercial and/or industrial customers."
Staff said that, upon review of Palmco's applications, Palmco meets the standards for supplier certification set forth in rule, including managerial, financial, and technical fitness
Staff stated, "In this filing, the Applications are seeking certification for large commercial and industrial customers, not residential customers. The services Indra seeks to provide with this certification will not involve either door-to-door sales or telemarketing activities to residential customers. The class of customers Indra seeks to serve are typically knowledgeable energy users unlikely to be misled in decisions regarding CRES and/or CRNGS services by a broker or marketer. Additionally, the Applications contain affidavits from Robert Palmese, the president and CEO of Indra, stating, among other things, that the Applicant will comply with all applicable rules and orders adopted by the Commission, and comply fully with the Commission and Staff on any utility matter including investigations of consumer complaints. Staff considers these to be appropriate measures to help prevent future issues of noncompliance with the Commission’s rules. Staff believes the Applications indicate that Indra has the managerial, financial, and technical fitness and capability to comply with all Commission rules and orders applicable to providing marketer brokerage services to large commercial and industrial customers."
As the matter remains pending before the PUCO, Palmco had no comment on the matter at this time
