ExxonMobil Entities Would Pay $92,000 Under Settlement With Texas PUC Staff

ExxonMobil Oil Corporation and ExxonMobil Refining & Supply Company, a subsidiary of Exxon Mobil Corporation, hereinafter referred to as "Exxon Mobil Corporation" (the ExxonMobil Entities), would pay $92,000 under a settlement with Staff of the Texas PUC to resolve the ExxonMobil Entities' alleged failure to file an initial emergency operations plan (EOP) and either annual updates or annual affidavits concerning the EOP, under 16 Texas Administrative Code (TAC) § 25.53(c)(1) and (c)(3)
ExxonMobil Oil Corporation and Exxon Mobil Corporation are both registered with the Texas PUC as power generation companies (PGC)
The settlement in one instance notes that an ExxonMobil company, ExxonMobil Power and Gas Services, was (previously) certified as a retail electric provider, and while certified as a REP ExxonMobil Power and Gas Services was subject to the EOP filing requirements. The settlement is not explicit as to ExxonMobil Power and Gas Services' EOP compliance, including whether the entity ExxonMobil Power and Gas Services is included within the settlement's terminology "the ExxonMobil Entities". A proposed order included with the settlement does not mention ExxonMobil Power and Gas Services. ExxonMobil Power and Gas Services voluntarily relinquished its Option 2 REP certificate, which was not being used, in 2025
The settlement states, "The ExxonMobil Entities failed to timely file its initial EOP and an executive summary in Project No. 53385 by April 18, 2022, as required under 16 TAC § 25.53(c)(1)."
The settlement states, "the ExxonMobil Entities did not file annual EOP updates or affidavits
associated with calendar year 2022 by March 15, 2023, annual EOP updates or affidavits
associated with calendar year 2023 by March 15, 2024, or annual EOP updates or affidavits
associated with calendar year 2024 by March 17, 2025."
The settlement states that ExxonMobil Oil Corporation filed its initial EOP and executive summary in Project No.
53385 on August 14, 2025.
