New York PSC Denies All Untimely Extension Requests From Brokers To File Financial Security

The Secretary of the New York PSC has issued a global order denying any and all untimely requests from retail energy brokers and consultants for an extension of the April 30, 2026 deadline to file financial security as part of their registration with the PSC

The deadline for an extension request had been April 27, 2026. Requests after such time are deemed untimely, the PSC's Secretary stated in an issuance

The PSC in a January 2026 broker registration order had set the deadline for the filing of financial security as April 30, 2026

Per the January 2026 order, requests for an extension of any compliance deadline under the order were to have been filed 3 days prior to the deadline, which, for the April 30, 2026 financial security deadline, was April 27, 2026

As first reported by EnergyChoiceMatters.com, several brokers filed for extensions on or before April 27, and the PSC has granted several extensions. (see those extensions granted to date here)

However, numerous extension requests have been filed after April 27, including several filed today, May 1, after the April 30 compliance deadline

The PSC Secretary issued an order today, May 1, providing that requests filed after April 27, 2026, which are seeking an extension of time to comply with the requirement to file a demonstration of broker/consultant financial accountability (Ordering Clause 8 of the Jan. 2026 Order), are denied as untimely

The PSC Secretary stated, "The financial accountability requirement exists for the protection of customers. Energy brokers and energy consultants were given ample notice of and time to comply with this requirement."

Generally, the security required by the PSC is $100,000 for registering Energy Brokers and $50,000 for registering Energy Consultants (background here)
