Plaintiff Dismisses PUC Complaint, Court Suit Against Texas REP Which Had Included Rare Court Order For REP To Remove Switch Hold

A complainant has filed to dismiss with prejudice a complaint at the Texas PUC against BKV-BPP Retail LLC (BKV Energy), with the complainant also filing a "notice of nonsuit with prejudice" in an associated Harris County court case
The proceedings had been notable because, as first reported by EnergyChoiceMatters.com, the complainant had obtained from the Harris County court, via a temporary restraining order granted without a hearing, an order from the court requiring the immediate removal of a switch hold placed on the complainant's account, in a rare, and possibly novel, action. The county court later confirmed the order requiring the removal of the switch hold after hearing from all parties

The customer's now-withdrawn complaint at the PUC had generally alleged that BKV-BPP Retail disconnected the customer at various points, and had alleged that BKV-BPP Retail did not properly document, memorialize in writing, or provide notice of amounts included or excluded from a deferred payment plan, allegedly contrary to rule. The customer's complaint had also generally alleged that disconnections have occurred without "meaningful" notice

The complainant has now at the PUC filed a motion to dismiss the PUC complaint with prejudice, stating that the complainant, "reached an agreement with BKV-BPP Retail LLC ('BKV Energy')
that resolves all the issues raised in the formal Complaint I filed with the Commission on December
15, 2025, and the subsequent filings I have made in this proceeding."
"I have executed a settlement
agreement and release that fully encompasses all claims and issues between myself and BKV
Energy that I have raised in this proceeding. I therefore no longer desire to pursue my Complaint
against BKV Energy. I hereby withdraw my Complaint against BKV Energy and request that it be
dismissed with prejudice, pursuant to 16 Tex. Admin. Code. § 22.181(a)," the complainant said in a PUC filing
A caption of a filing in the Harris County court case is labeled as a "Plaintiffs' Notice of Nonsuit with Prejudice".
