PUC Corrects Order Fining Retail Suppliers, Brokers Who Have Failed To Remit Fiscal Assessment; Sets New Forfeitures

The PUC of Ohio has rescinded an April 14, 2026 order issuing a $1,000 civil forfeiture on multiple retail energy suppliers and brokers, and has issued an updated order imposing such forfeitures
PUCO explained that the April 14 order had incorrectly described the list of entities subject to the forfeiture as entities which had failed to file annual reports for 2023 and/or 2024
PUCO said that the April 14 order should have identified the listed companies as those who had failed to remit their fiscal assessment based on their 2023 and/or 2024 annual reports.
PUCO has rescinded its prior April 14 order imposing a civil forfeiture against each of the companies listed in the April 14 order
However, PUCO newly directed the imposition of a $1,000 civil forfeiture on a list of companies included in PUCO's corrected order who have allegedly failed to pay their assessments, except that the effective date of the forfeiture was delayed for 30 days to allow the subject companies to seek rehearing (click here for a list of the companies subject to the new forfeiture, starting on page 4)
PUCO established a deadline of June 12, 2026 for the listed companies to pay their assessment, or be subject to potential additional forfeiture
PUCO further warned that failure to pay the assessment by the deadline could subject the companies to revocation of their supplier or broker certificate
