People's Counsel Seeks To Make More Retail Supplier Data Public

The Maryland Office of People's Counsel has sought rehearing of a recent Maryland PSC order which requires the public disclosure of various retail energy supplier data, including customer counts, as OPC said that supplier volumes should not be afforded confidential protection, or, alternatively, such confidential protection should have an end date for specific data
As first reported by EnergyChoiceMatters.com (details here), the PSC directed that, among other information, the data showing the number of residential accounts served by each retail electric and natural gas supplier, broken out by service area and then by billing type, shall be made public
The PSC, however, did grant confidential protection to retail suppliers' monthly reporting of volume data
In a rehearing request, OPC said that the Commission should require supplier-specific total energy usage to be reported publicly, "unless a legally sufficient basis for confidential treatment is established." While OPC is not explicit, the data at issue is limited to residential data, as the PSC does not require the reporting of non-residential data by suppliers
OPC said that electric suppliers (but not retail natural gas suppliers) are required to report monthly volumes to the federal EIA, with such supplier-specific volume data posted publicly by EIA nine months after the end of the reporting year
For both electricity and gas, OPC said that the PSC should adopt a similar approach to that used by the EIA, where confidential protection is time-limited, with OPC adding that, "The Commission should also consider whether a shorter period [vs. EIA] is warranted to serve SB 1’s Maryland-specific purpose of enabling timely oversight of the retail supply market."
OPC said, "A time-limited approach would address any concern that immediate disclosure of current monthly usage could reveal current supplier market-share information while preserving the public reporting purpose of Senate Bill 1."
