PUCO Denies FirstEnergy Solutions' Petition for Additional Market Enhancements at DP&L

The Public Utilities Commission of Ohio has denied FirstEnergy Solutions' requested retail market enhancements at Dayton Power & Light.

Dayton Power & Light had filed revisions to its supplier coordination tariff to implement certain retail market enhancements contained in a stipulation regarding its acquisition by the AES Corporation., such as the introduction of bill ready billing, greater provision of capacity and transmission peak load contribution data, and a reduction in certain fees charged to suppliers (see 11/22)

FirstEnergy Solutions was not a signatory to the settlement, and protested the revised tariff as not eliminating all barriers to retail competition.

Among other things, FirstEnergy Solutions sought to increase the interval meter threshold at Dayton Power & Light to 200 kW. The current cutoff is 100 kW.

FirstEnergy Solutions also sought the introduction of "percentage off" billing, and called proposed charges for rate ready consolidated billing, electronic data interchange related to dual billing, and registration of rate codes inappropriate

Additionally, FirstEnergy Solutions said that the 12-month minimum stay for large customers should be eliminated.

PUCO was not persuaded that Dayton Power & Light's proposed tariffs were unjust or unreasonable, and approved them as filed.

"However, although we are finding in this Finding and Order that the proposed tariffs in this proceeding do not appear to be unjust or unreasonable, the Commission will continue to ensure effective retail electric choices for consumers and expects DP&L in its upcoming standard service offer proceeding to work with CRES providers and other interested stakeholders to identify potential barriers to retail competition and to demonstrate, within its service territory, an effective process for facilitating retail electric service competition," PUCO ordered.
