Constellation Energy Statement: MXenergy Transfer of Post-Pay Accounts to StarTex "Completely Unrelated" to PUCT Audit

In response to Matter's March 2 story concerning MXenergy's decision to transfer post-pay customers in ERCOT to affiliate StarTex Power, and an audit settlement at the PUCT which made reference to the transfer, Constellation Energy issued the following statement to Matters:

"[T]he PUCT audit is completely unrelated to the transfer of MX customers to StarTex."

"The transfer of customers is an expected practice following a merger to gain efficiencies, and Constellation acquired both StarTex and MX last year. The audit was a standard consumer protection audit that all REPs certified by the PUCT have or will have to participated in during this recent audit cycle."

Matters does not believe anything reported in its story was inaccurate, and did not report that the transfer was prompted in any way by the audit or settlement.

Constellation agreed that Matters' story was precisely worded, but said that a non-careful reader could be left with the wrong impression.
