Texas Staff Files Preliminary List of REPs Which May Be Designated as Non-Volunteer POLRs

Staff of the Public Utility Commission of Texas has filed its preliminary determination of retail electric providers which are eligible to serve as Large Service Providers (non-volunteer POLRs) for the 2013-2014 term, for each customer class and POLR service area.

Staff also reported that no REPs have filed to serve as volunteer POLRs for the 2013-14 term.

REPs listed as eligible to serve as a non-volunteer POLR in at least one service area and customer class, and thus may be designated by the Commission as a non-volunteer POLR for such customer class and service area per the procedure in the Substantive Rules, are listed below. A complete listing of which REPs are preliminarily designated as an eligible non-volunteer POLR for each service area and customer class can be found in the linked document above.

By Substantive Rule, in each POLR area, for each customer class, the Commission shall designate up to 15 Large Service Providers (non-volunteer POLRs). The eligible REPs that have the greatest market share based upon retail sales in megawatt-hours, by customer class and POLR area, shall be designated as Large Service Providers.

Per SUBST. R. 25.43(h)(3) and 25.43(i)(3), REPs may challenge their eligibility to be a POLR within five business days of the notice of eligibility by filing and submitting to the Commission Staff documentation, calculations and a specific explanation that clearly illustrates and supports the REP's assertion. Staff will accept challenges and clarifications through Friday, September 14, 2012

After Staff has investigated any challenges, Staff will designate up to 15 REPs from the eligible list to serve as Large Service Provider (LSP) POLRs for the 2013-2014 two-year term.
