Illinois Issues First Notice Rule to Require Licensing of Entities Installing, Maintaining Electric Vehicle Charging Stations

The Illinois Commerce Commission has issued a First Notice order containing proposed rules which require that entities installing, maintaining, and repairing electric vehicle (EV) charging stations shall be certified by the Commission.

After the initial compliance date specified in the First Notice proposed rule, which is January 1, 2014, all persons or entities that install, maintain, or repair electric vehicle charging stations in the State of Illinois shall be certified by the Commission prior to installing, maintaining, or repairing electric vehicle charging stations in the State of Illinois, with the exception of a self-installer.

A "self-installer" means an individual who (i) leases or purchases an electric vehicle charging station for his or her own personal use and (ii) installs an electric vehicle charging station on his or her own premises without the assistance of any other person.

A fee of $50 shall apply to applications for a certificate, under the First Notice rule.

Among other things under the First Notice rule, the certificate holder must certify that they will submit notifications to the servicing electric utility in accordance with the requirements specified in the applicable tariffs of the servicing electric utility, law, and regulation.

A certificate holder shall recertify annually to remain in good standing with the Commission, which shall include filing a reprot with the ICC.

Among the information required in the recertification report under the First Notice rule is the number of electric vehicle charging stations, classified by customer class and charging capacity, that the certificate holder installed during the prior calendar year in each electric utility's service area.
