The Hercules, Calif. City Council has approved an agreement under which Pacific Gas and Electric Company will purchase the assets of Hercules Municipal Utility (HMU).

Municipal utilities in California typically do not offer direct access. A review of Hercules Municipal Utility's tariff did not indicate that direct access was offered to customers of the municipal utility.

PG&E offers a capped amount of direct access load, which is currently fully subscribed. To the extent PG&E serves the former Hercules Municipal Utility customers under the same, or substantially similar, tariff as its existing customers, these former municipal customers would receive eligibility to take direct access service, subject to the cap.

Hercules Municipal Utility is a municipal electric utility owned and operated by the City of Hercules since March 2003. It has about 900 customers.
