Pennsylvania Lifts Termination Fee Cap, Extended Cancellation Period Requirement from Retail Supplier

The Pennsylvania PUC has lifted from a retail supplier certain sales and marketing conditions previously imposed on the retail supplier at licensure due to prior concerns over customer complaints in other states.
Specifically, the PUC has released Just Energy Pennsylvania Corporation from a series of conditions imposed on the supplier at licensure, and which have been in effect to date, as the PUC found that Just Energy has operated in good faith and compliance with the conditions, and has maintained the appropriate complaint ratio and customer service level commitments.
Notable conditions originally imposed on, and now lifted from, Just Energy were:
• Just Energy was to provide an extended cancellation period of up to 30 days after the issuance of the first bill on the company's supply service during which the customer will not pay a termination fee
• Any early termination or exit fee imposed by Just Energy was to not exceed $50 per contract
• Just Energy was to only use employees, not independent contractors, when conducting door-to-door sales
• Just Energy was to conduct background checks on all potential employees
• All Just Energy marketing materials to be used, including contracts and customer-facing materials, were to be provided to Commission staff for comment five days prior to use
• Just Energy was to provide various complaint and monitoring reports to the PUC
With regard to any condition that has been released by the Commission, for a period of three years following the condition's release, Just Energy is still required to provide the Commission with written notice of any change to the company's practices and procedures that was the subject of the released condition.
Just Energy must still comply with applicable Commission regulations.
